The User shall pay any applicable taxes, including sales, use, personal property, value-added, excise, customs fees, import duties or stamp duties or other taxes and duties imposed by governmental agencies of whatever kind and imposed with respect to the transactions under the user’s account

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

PART 20 - KYC AND AML POLICY

Introduction:

Like the Republic of Indonesia Law No. 8 2010 concerning the prevention and eradication of criminal acts of money laundering and Republic of Indonesia Law No. 9 of 2013 concerning the prevention and eradication of criminal acts of terrorism funding.

In tpro.co.id activities participate and actively support the government's efforts to eradicate TPPU activities and eradicate criminal acts of terrorism funding.

Then by using TRIV PRO you agree to participate in TRIV PRO AML (anti money laundry) and KYC (know your customer) Policy. This can result in some of the actions we take for our clients as below:

IDENTIFICATION PROCEDURE AND EXAMINATION OF WHOLE CLIENTS

TRIV PRO has adopted all legal requirements relating to the client's comprehensive identification and inspection procedures as follows:

A comprehensive inspection procedure is applied in the following cases:

  • When building a business relationship.
  • When carrying a transaction amount of 5,000,000 IDR (Five million rupiahs) or more, both transactions are carried out in one operation or in some operations that appear to be related.
  • When there are allegations of money laundering or terrorist funding, regardless of the number of transactions.
  • When there is doubt about the correctness and adequacy of client identification data obtained previously
  • When there are doubts regarding the source of funds or bank ownership.

EXAMINING PROCEDURES FOR CLOSING THE CLIENT

A thorough examination procedure consists of:

  • Identify clients and verify client identity based on information obtained from reliable and independent sources.
  • Identify beneficiary owners and take risky and adequate actions to verify their identity based on documents, data or information issued or received from reliable and independent sources. Relating to legal entities, associations and similar legal entities, taking risky and adequate actions to understand the client's ownership and control structure.
  • Obtain information about the intent and purpose of a business relationship.
  • Monitoring ongoing business relationships including checks of transactions conducted throughout the relationship to ensure that the transactions being carried out are consistent with the data and information held by the company in connection with the client.

UPDATE CLIENT IDENTIFICATION

Overview of existing records must be carried out periodically, so as to ensure that the documents, data or information held are maintained. The client's comprehensive inspection procedure must be applied not only to all new clients but also to clients who are at the right time sensitive risk.

PERFORMANCE EXAMINATION PERFORMANCE BY THE THIRD PARTY

TRIV PRO is permitted to rely on third parties to fulfill the requirements for a full client examination. But the primary responsibility for meeting these requirements remains with TRIV PRO, which depends on third parties.

PROCEDURE KEEPING NOTES

TRIV PRO must maintain the following documents and information for use in investigations, or analyzes, about the possibility of money laundering or terrorist funding by national authorities:

  • The name and address of the client and a copy or record of official identification documents (such as a passport, identity card, or driving license).
  • Name and address (or identification code) of the opposite party.
  • Form guidelines or authority.
  • Details of the account where funds are paid.
  • The form and purpose of payments made by businesses to clients.
  • Business correspondence

For a full client check, a reference copy of the evidence is required, for a period of at least 10 years after the business relationship with the client has expired.

For business relationships and transactions, supporting evidence and records for a period of at least 10 years after making a transaction or terminating a business relationship.

KYC DOCUMENTATION

After a thorough inspection procedure, TRIV PRO will ask the client to submit the following documentation:

Individual customers:

  • Photocopy of KTP / Passport / National SIM or other forms of identity including photos.
  • Latest evidence about home addresses on behalf of that person.
  • All documents / certificates may not exceed 4 months.
  • Bank account ownership such as Bank Statement / Bank Book.
  • Certified copy of National ID card / Passport / Driver's License or other form of identity with photograph included;
  • A recent certified proof of home address in the person name. All documents / certificates must not be more than 4 months old
  • Bank account ownership such as Bank Statement / Bank Book

Company Customers:

  • Deed of establishment of deposits by the Minister of Law of the Republic of Indonesia
  • Proof of Company Offer (SIUP - Trading Business License)
  • Bank account ownership such as Bank Statement / Bank Book
  • Personal information to one Director (various verification documentation required for identity and proof of address): A copy of his national ID / passport (with photo and signature specimens included) 1 latest copy if confirmation of address in the person's name.
  • personal information about the maximum beneficiary owner with 10% or more ownership (various verification documentation required for identity and proof of address): A copy of his national identity card / passport (with photo specimens and signatures included). 1 recent copy if confirmed address in the person's name.

Attention: All document information must not be more than 6 months

Failure or refusal by the client to submit data and information to verify his identity and make his economic profile, without sufficient justification, is an element that could lead to the creation of suspicions that clients are involved in money laundering or terrorist financing activities.

In this case, TRIV PRO will not continue any business relationships and consider whether anti-money laundering officers are required to report.

This action allows TRIV PRO to take the necessary actions including terminating accounts, making lawsuits, and informing local authorities.

Any remaining balance or related to termination of account will NOT be replaced. The remaining balance will be frozen until the local government completes the investigation and final court decision.
